From June 1, new «800+» payment rules for foreigners are in effect in Poland

As of June 1, 2026, new rules for the 800+ benefit payment for foreigners will come into effect in Poland. The Social Insurance Institution (ZUS) explains that the right to payment will only remain for those who are employed in Poland. Similar restrictions for Ukrainians with UKR status have been in place since February

According to ZUS, as of February 1, 2026, new conditions apply for Ukrainians with UKR status: in order to receive 800+, a parent must be employed or otherwise economically active.

Additional requirements have also been introduced for children: depending on their age, they must attend school, undergo mandatory one-year preschool preparation, or study at a Polish educational institution. An exception is made for children under 6 years old. Both the parent and the child must reside in Poland.

As of June 1, 2026, similar rules will also apply to other foreigners from non-EU and non-EFTA countries who legally reside in Poland and have access to the labor market. The new regulations will not affect Polish citizens, as well as citizens of the EU, EFTA, and the UK who fall under the Brexit agreement, emphasizes ZUS.

To receive 800+, foreigners must submit an application and include: the PESEL of the applicant and the child, border crossing data, proof of legal residence in Poland, as well as evidence of labor activity. Additionally, a declaration is required stating that the child is studying at a Polish school or attending kindergarten.

Labor activity includes, in particular, work under an employment contract or contract for services, running a business, receiving sports or doctoral scholarships. The status of unemployed with the right to benefits and participation in paid training programs is also taken into account.
