Pyszne.pl will lay off around 5,000 couriers in Poland: many of them are foreigners, the Ministry of Labor has started an inspection

The company Takeaway Express Poland, operating under the brand Pyszne.pl, plans to lay off all its couriers — around 5000 people, a significant portion of whom are foreigners — by the end of August. This was reported on July 17 by the Ministry of Family, Labor and Social Policy of Poland.

According to the union OPZZ Konfederacja Pracy, after being dismissed, couriers will be offered to return to work, but not directly through Pyszne.pl, rather through one of five so-called «fleet partners» — intermediary companies between the platform and the performers.

Moreover, the union states that intermediaries intend to charge workers an additional fee for processing and managing contract payments. OPZZ called this practice absurd, as employees will effectively have to pay the company that hires them

Ministerstwo Pracy zażądało przyspieszenia inspekcji

After the information about mass layoffs emerged, the Minister of Family, Labor and Social Policy, Agnieszka Dziedzic-Bąk, reached out to the Chief Labor Inspector requesting to expedite the verification of the grounds on which the couriers of Pyszne.pl are employed. The inspection is already being conducted by the National Labor Inspectorate.

As of July 8, new regulations have come into force in Poland that allow inspectors to require the replacement of fictitious civil law contracts and B2B contracts with full employment contracts. If an inspection shows that couriers should have actually been employed as hired workers, the provisions of the law on collective redundancies may apply to the situation. In this case, the company will be required to consult with trade unions and pay employees the legally mandated severance packages

New regulations for platform employment are being prepared in Poland

At the same time, the Polish government is preparing a law that will implement the European Directive on platform work. The new regulations are intended to strengthen the protection of the rights of couriers and drivers working with digital platforms, including Pyszne.pl, Glovo, and Uber.

Assume, że ochrona będzie dotyczyć nie tylko pracowników zatrudnionych bezpośrednio przez platformy, ale także tych, którzy współpracują z nimi za pośrednictwem pośredników.

Polska musi wdrożyć postanowienia dyrektywy europejskiej do grudnia 2026 roku. Projekt ustawy został już przygotowany i wkrótce zostanie przekazany do przeglądu rządowego, po czym zostanie poddany konsultacjom publicznym.
